1. Introduction
Welcome to SparkThreadWave ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at sparkthreadwave.sbs (the "Service") operated by SparkThreadWave.
By booking a charter or using our Service, you agree to be bound by these Terms. If you do not accept any part of the terms, then you must refrain from using the Service.
2. Service Overview
SparkThreadWave offers superior yacht charter services, which include, but are not restricted to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Our services are available depending on weather conditions and other factors. We retain the authority to adjust or discontinue our services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you are required to:
- Be at least 18 years old
- Provide valid and full information
- Make the necessary deposit as detailed in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Your reservation is only validated after we receive payment and send a confirmation in writing. We hold the right to decline service at our sole discretion.
3.3 Availability
Charter bookings depend on the vessel's availability and fitting weather conditions. We will try to fulfill your requested dates and times to the best of our ability.
4. Payment Terms
4.1 Pricing
All costs are quoted in $ and are inclusive of all relevant taxes unless stated otherwise. Pricing is subject to modifications without any prior announcement.
4.2 Payment Schedule
- Deposit: A requirement of 50% of the whole charter fee at the time of booking
- Balance: Payable 48 hours prior to the start of the charter
- Extra charges (if applicable): Payable upon the completion of the charter
4.3 Payment Methods
We accept payments through major credit cards, wire transfers, and guaranteed cheques. All payments are processed with secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Refund in full minus transaction fees
- Between 24 to 72 hours before departure: 50% refund
- Less than 24 hours before departure: No refund will be provided
5.2 Weather Cancellations
In the case where unsafe weather conditions are determined by our captain, we will propose to:
- Reschedule your charter at no extra cost to another available date
- Issue a full refund if rescheduling isn’t achievable
5.3 Mechanical Issues
Should your selected vessel encounter mechanical issues, we will endeavor to supply an adequate replacement. If a substitute is unobtainable, we will provide a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
It is mandatory for all passengers to:
- Adhere to instructions given by the crew
- Utilize safety gear as and when instructed
- Declare any medical conditions impacting their well-being
- Stay within assigned areas of the yacht
6.2 Prohibited Items
The items listed below are prohibited on the yacht:
- Glass containers
- Illegal substances
- Weapons of any kind
- Excessive liquor beyond reasonable personal consumption
- Pets, unless they have been given prior clearance
6.3 Conduct
Passengers are expected to behave in a respectable and orderly manner. We maintain the right to cease a charter without giving a refund if a passenger's actions pose a safety threat or ruin the ambiance for others.
7. Liability and Insurance
7.1 Our Liability
We are only liable up to the paid amount for your charter and are not accountable for:
- Personal injuries caused by the negligence of any passenger
- Theft or destruction of personal belongings
- Indirect, incidental, or punitive damages
- Delays due to weather or scenarios out of our control
7.2 Insurance Coverage
Our insurance provides comprehensive maritime coverage for our fleet and operations. It is your responsibility to secure personal travel and belongings insurance.
7.3 Assumption of Risk
By participating in our charter services, you acknowledge the inherent risks associated with maritime activities and accept responsibility for your personal safety.
8. Modifications and Itinerary Changes
We have the authority to alter itineraries, paths, or schedules due to factors concerning weather, safety, or operational needs. We will make every attempt to ensure an equivalent experience is provided.
9. Force Majeure
We will not be held accountable for interruptions, cancellations, or changes caused by conditions beyond our control, which can include but are not limited to:
- Heavy weather events
- Nature-related disasters
- Governmental mandates
- Port shutdowns
- Mechanical breakdowns
10. Privacy and Data Protection
We protect your personal data in alignment with our Privacy Policy. By engaging with our services, you consent to the collection and use of your information as outlined in our Privacy Policy.
11. Intellectual Property
All material on our website, such as text, graphics, logos, and images, is subject to copyright and trademark protections. Unauthorized reproduction, distribution, or creation of derivative works is forbidden without our express written consent.
12. Governing Law
The laws of USA govern these Terms, and any disputes will be adjudicated in the courts of Miami Beach, USA.
13. Changes to Terms
We have the right to adjust these Terms periodically. Amendments will be posted on our website with a notification of the revision date. Continual use of our services confirms acceptance of new terms.
